Terms & Conditions

1.Acceptance of these terms

By accessing or using the Service you confirm that you can form a binding contract, you are at least 16 years old (or the age of digital consent where you live), and you'll comply with these Terms and all applicable laws. If you use the Service on behalf of an organisation, you confirm you have authority to bind it to these Terms.

2.The Service

netPanel lets you turn screens into living dashboards — clocks, photos, calendar, weather, news, smart‑home controls, home cameras and more — set up from your phone and shown on the screens you choose. Some features require a paid plan, an internet connection, or compatible hardware. We're always improving the Service, so features may be added, changed or removed over time.

3.Your account

• You're responsible for keeping your login details secure and for all activity under your account.
• Provide accurate information and keep it up to date.
• Tell us promptly at info@netpanel.tech if you suspect any unauthorised use of your account.
• You may share a screen or account with people you choose; you're responsible for their use.

4.Plans, billing & cancellation

• We offer free and paid plans. Paid subscription fees are billed in advance on a recurring basis (for example monthly or yearly) and renew automatically until you cancel.
• You can cancel anytime from your account; your paid access continues until the end of the current billing period, and we don't charge you again after that.
• Prices may change; we'll give you reasonable notice before a change affects you, and any increase applies from your next billing period.
• Fees are stated inclusive or exclusive of taxes as shown at checkout; you're responsible for applicable taxes.
• Except where required by law (including the Australian Consumer Law) or stated in our refund policy, payments are non‑refundable.

5.Hardware & devices

If you buy a netPanel device (such as the Home netPanel), the sale is also subject to the purchase terms and any warranty provided at the time of sale. Devices need a compatible setup and internet connection, and many device features depend on the Service remaining available. Nothing in these Terms limits the consumer guarantees that apply to goods under the Australian Consumer Law.

6.Your content

You keep ownership of your content — your photos, calendar, notes, layouts and anything else you add. To run the Service, you grant netPanel a limited, worldwide, non‑exclusive licence to host, store, process and display that content solely to provide the Service to you and the people you share it with.

You're responsible for the content you add and must have the rights to use it. Don't upload anything unlawful, infringing, or that you don't have permission to use. We may remove content that breaches these Terms or the law.

7.Acceptable use

When using the Service, you agree not to:

• break the law or infringe anyone's rights (including intellectual property or privacy);
• upload malware or attempt to gain unauthorised access to the Service, accounts or systems;
• interfere with, disrupt or overload the Service;
• copy, resell, rent or commercially exploit the Service without our written permission; or
• reverse‑engineer or attempt to extract our source code, except to the extent the law allows.

8.Third‑party services & content

The Service connects to third parties (for example Google, weather and news providers, and payment processors) and may show third‑party content. Those services are governed by their own terms and privacy policies, and we're not responsible for them. Your dealings with third parties are between you and them.

9.Our intellectual property

The netPanel name, logo, software, designs, and the clock faces and other content we provide are owned by netPanel or our licensors and are protected by law. We grant you a limited, revocable, non‑transferable licence to use the Service for its intended purpose. You don't acquire any ownership rights, and all rights not expressly granted are reserved.

10.Privacy

Our Privacy Policy explains how we handle your personal information. By using the Service, you acknowledge that handling.

11.Disclaimers

To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis. We don't warrant that the Service will be uninterrupted, error‑free, or that content (such as weather, news or third‑party data) will always be accurate. This section does not exclude any rights or guarantees that cannot be excluded under applicable law.

12.Limitation of liability & the Australian Consumer Law

Subject to those rights, and to the maximum extent permitted by law: (a) netPanel is not liable for indirect, incidental, special or consequential loss, or loss of data, profits or goodwill; and (b) where our liability can lawfully be limited, our total liability to you is limited, at our option, to re‑supplying the relevant service (or the cost of doing so) or the amount you paid us for the Service in the 12 months before the claim.

13.Termination

You can stop using the Service and close your account at any time. We may suspend or end your access if you breach these Terms, if required by law, or if we discontinue the Service (we'll give reasonable notice where we can). On termination, your right to use the Service ends; sections that by their nature should survive (such as content licences you've granted, IP, disclaimers and liability) continue to apply.

14.Changes to these terms

We may update these Terms from time to time. If we make material changes, we'll post a notice on the Service and update the "Last updated" date above. If you keep using the Service after the changes take effect, you accept the updated Terms.

15.Governing law

These Terms are governed by the laws of Victoria, Australia, and you and netPanel submit to the non‑exclusive jurisdiction of the courts of Victoria. If any provision is found unenforceable, the rest of the Terms continue in effect.
